Welcome to Vibbit (vibbit.ai). These Terms of Service govern your access to and use of our AI-powered video creation platform, tools, and related services. By creating an account or using our services, you agree to be bound by these terms. Please read them carefully before using Vibbit.
Acceptance of Terms
By accessing or using Vibbit's services, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree to these terms, you may not access or use our services.
Account Registration
To access certain features of Vibbit, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized access to your account. You must be at least 16 years of age to create an account and use our services. By registering, you represent that you meet this age requirement.
Your Content
You retain full ownership of all content you upload, create, or submit through Vibbit, including videos, audio, images, text, and any other materials. Vibbit does not claim any ownership rights over your content. By using our services, you grant Vibbit a limited, non-exclusive, royalty-free license to host, store, process, and display your content solely for the purpose of operating, providing, and improving our services to you. This license exists only for as long as you maintain your content on our platform and terminates when you delete your content or close your account. You represent that you have all necessary rights and permissions to upload and use the content you provide, and that your content does not violate any third-party rights or applicable laws.
AI-Generated Content
Vibbit's AI features may generate or assist in creating content such as videos, images, text, and audio. You may use AI-generated content created through your use of our services for any lawful purpose, subject to these terms. You are responsible for reviewing AI-generated content before publishing or distributing it, and for ensuring it does not infringe on any third-party intellectual property rights or violate applicable laws. AI-generated content may occasionally produce unexpected or inaccurate results. We recommend disclosing the use of AI-generated content where appropriate or where required by applicable laws and platform guidelines.
Acceptable Use
You agree to use Vibbit only for lawful purposes and in accordance with these terms. You may not use our services to create, upload, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. You may not use our services to infringe upon any intellectual property rights, create deepfakes or synthetic media intended to deceive or defraud others, generate misleading content designed to spread disinformation, or distribute malware or any harmful code. You may not attempt to circumvent any usage limits, access controls, or security measures of our platform. Violation of these acceptable use policies may result in immediate suspension or termination of your account.
Intellectual Property
The Vibbit platform, including its software, design, branding, logos, and documentation, is the intellectual property of Vibbit and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our platform. If you believe that content on Vibbit infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA) or equivalent local law. Please send copyright complaints to support@vibbit.ai with a detailed description of the alleged infringement.
Subscriptions & Payments
Vibbit offers both free and paid subscription plans. Paid subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide prorated refunds for partial billing periods. Vibbit reserves the right to change subscription pricing with reasonable advance notice. Price changes will not affect your current billing cycle and will take effect at the next renewal.
Free Tools
Vibbit offers certain browser-based tools that are available for free and may not require account registration. These free tools are provided on an as-is basis without any warranties or guarantees of availability. Free tools may process content directly in your browser without uploading it to our servers. Usage of free tools may be subject to daily or session-based limits. Vibbit reserves the right to modify, limit, or discontinue free tools at any time without prior notice.
Disclaimer of Warranties
Vibbit's services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We do not guarantee that our services will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by applicable law, Vibbit disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, complete, or suitable for any specific purpose.
Limitation of Liability
To the maximum extent permitted by law, Vibbit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of profits, data, or business opportunities. Our total aggregate liability for any claims arising under these terms shall not exceed the greater of the amounts you have paid to Vibbit in the twelve (12) months preceding the claim or one hundred US dollars ($100).
Indemnification
You agree to indemnify, defend, and hold harmless Vibbit and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of our services, your content, or your violation of these terms. This indemnification obligation will survive the termination of your account and these terms.
Termination
You may terminate your account at any time by contacting us or through your account settings. Vibbit may suspend or terminate your access to our services at any time if you violate these terms, engage in activity that may cause harm to other users or our platform, or if required by law. Upon termination, your right to use our services will cease immediately. We will retain your content for a reasonable period to allow you to export it, after which it will be deleted in accordance with our Privacy Policy. Provisions related to intellectual property, limitation of liability, indemnification, and governing law will survive termination.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Vibbit operates, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the applicable jurisdiction.
Changes to Terms
We may revise these Terms of Service from time to time. When we make material changes, we will notify you by email or through a prominent notice on our platform at least 30 days before the changes take effect. Your continued use of Vibbit after the revised terms become effective constitutes your acceptance of the updated terms. If you do not agree to the revised terms, you should discontinue your use of our services and close your account.
